Gamler.io ("Gamler", "we", "us", "our") operates gamler.io and provides a Facebook advertising research ("ad spy") service, together with account access, billing, and customer support. We are committed to respecting and protecting your privacy and to complying with applicable data-protection laws.
This Privacy Policy (the "Policy") explains what personal data we collect about you when you use the Website at https://gamler.io and the Services, how we use and protect it, when we may share it, and the rights you may have in relation to that data. By using the Website and/or the Services, you agree to this Policy. If you do not agree, you must stop using the Website and the Services immediately.
1. Definitions
- "Gamler" — the operator of the Website (gamler.io) and the provider of the Services.
- "Services" — analytics and data-aggregation services relating to advertising on the Facebook advertising network, including access to a catalog of advertising creatives and tools that Gamler has collected from open sources and indexed.
- "Administration" — the personnel authorized to operate the Website and to determine the purposes and means of processing Personal Data.
- "Personal Data" — any information relating directly or indirectly to an identified or identifiable natural person (the User).
- "Processing" — any operation performed on Personal Data, with or without automated means, including collection, recording, organization, storage, updating, retrieval, use, transfer, blocking, deletion, and destruction.
- "User" — a person who accesses the Website over the Internet and/or uses the Services.
- "Cookies" — a small piece of data sent by the web server and stored on the User's device and returned to the server on subsequent requests. Users may disable or delete Cookies through their browser settings, but the Website may then not function fully.
- "IP address" — an Internet Protocol address that identifies a device on a network.
2. General Information
- Using the Website and/or the Services means you accept this Policy and the terms on which your Personal Data is processed.
- If you disagree with this Policy, you must immediately stop using the Website and the Services.
- This Policy applies only to the Website. Gamler does not control and is not responsible for third-party websites reachable through links on the Website.
- The Administration does not verify the Personal Data provided by the User and assumes the User provides accurate, sufficient, and up-to-date information.
- Note that the advertising creatives in our catalog are collected from open, publicly available sources. This Policy governs the Personal Data of Users of the Service, not the content of third-party advertisements indexed in the catalog. Requests concerning indexed advertising content should be sent to support@gamler.io.
3. What Data We Collect
We may acquire, store, process, use, and disclose the Personal Data you submit while using the Website and/or the Services, as defined by this Policy. By using the Website and/or the Services you authorize Gamler to do so on the terms set out here.
Personal Data you provide by filling out forms on the Website may include:
- your contact information;
- your email address;
- your name or display name;
- payment-related information processed by our payment providers (we do not store full card details ourselves).
We may also automatically collect technical data such as your IP address, browser and device information, and usage data through Cookies and similar technologies.
Any other personal information is also subject to secure storage and non-disclosure, except as provided in Sections 5 and 6 of this Policy.
4. Why We Process Your Data
The Administration may use your Personal Data to:
- identify you;
- provide access to the personalized resources of the Website (your Account);
- maintain communication with you, including notices, requests, and processing of your inquiries;
- confirm the accuracy and completeness of the data you provide;
- provide effective customer and technical support;
- provide and charge for the Services, and inform you about changes or additions to them;
- evaluate the quality of the Services and carry out Gamler's marketing activities;
- protect the rights and legitimate interests of the User, Gamler, and third parties in accordance with applicable law;
- prevent fraud and ensure the security of the Website.
5. How and How Long We Process Data
- Personal Data is processed for as long as necessary for the purposes above, by any lawful means, with or without automated tools.
- Your Personal Data may be transferred to authorized state authorities only on the grounds and in the manner prescribed by applicable law.
- In the event of loss or unauthorized disclosure of Personal Data, the Administration will inform the affected User.
- The Administration takes the necessary organizational and technical measures to protect Personal Data against unauthorized or accidental access, destruction, modification, blocking, copying, distribution, or other unlawful acts of third parties.
6. Legal Bases for Processing
Personal Data is processed in compliance with generally accepted international law and the rules applicable to you, including, without limitation:
- EU — Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR");
- United Kingdom — the Data Protection Act 2018 and the UK GDPR;
- Australia — the Privacy Act 1988;
- Canada — the Personal Information Protection and Electronic Documents Act ("PIPEDA");
- New Zealand — the Privacy Act 2020;
- California — the California Consumer Privacy Act ("CCPA");
- Brazil — the Lei Geral de Proteção de Dados ("LGPD").
Children. The Services are not directed to children. The Children's Online Privacy Protection Act ("COPPA") governs the online collection of personal information from minors under 13 within US jurisdiction. We do not knowingly collect data from children under 13. A parent or guardian who believes a child has provided us data may email support@gamler.io to review, delete, or stop further collection of that data.
7. Data-Processing Principles
To protect your Personal Data, Gamler follows the principles below (consistent with Art. 5 GDPR where you are in the EU):
- Purpose limitation — we collect Personal Data only for specified, explicit, and legitimate purposes and do not process it in ways incompatible with those purposes.
- Accuracy — we take reasonable steps to keep Personal Data accurate and up to date, and to promptly correct or erase inaccurate data.
- Lawfulness, fairness, and transparency — we process Personal Data lawfully, fairly, and transparently.
- Data minimization — we gather only as much Personal Data as is necessary for the purposes of processing.
- Storage limitation — we keep Personal Data in identifiable form no longer than necessary for the purposes of processing.
- Integrity and confidentiality — we process Personal Data with appropriate technical and organizational security measures.
8. Your Rights
Depending on your jurisdiction, you may have the right to access, correct, delete, or restrict processing of your Personal Data, to object to processing, to data portability, and to withdraw consent. You can exercise most of these rights directly from your Account, or by contacting support@gamler.io.
You may delete your Personal Data and Account at any time from the settings page at https://gamler.io/profile. After your request is received, the data is deleted promptly.
9. Responsibilities of the Parties
The User must:
- provide the Personal Data necessary for Gamler to provide the Services;
- keep their Account credentials secret and not transfer Account access to third parties;
- not use any automated means to collect data from the Website.
The Administration must:
- use Personal Data only for the purposes in Section 4;
- store Personal Data securely and not sell, exchange, publish, or otherwise disclose the User's Personal Data, except as provided in Sections 5 and 6 or as needed to provide a Service the User has requested;
- take reasonable and necessary precautions to protect Personal Data;
- block the relevant User's Personal Data, from the time of a request by the User, their legal representative, or a competent authority, for the duration of a verification, where inaccurate data or unlawful actions are detected.
If Personal Data is disclosed, Gamler and the Administration are not responsible where that information: (a) became public before its loss or disclosure; (b) was received from a third party before the Administration received it; or (c) was disclosed with the User's consent.
If the User breaches any obligation in this Section, the Account may be permanently blocked without the possibility of unblocking or refund of fees paid for the Services.
10. Cookies
We use Cookies and similar technologies to operate the Website, remember your preferences, keep you signed in, analyze usage, and improve the Services. You can disable or delete Cookies in your browser settings; some features of the Website may then not work properly.
11. Technologies and Service Providers
We keep our stack lean and rely on a small number of trusted third-party providers to run the Service. Each one processes only the data it needs for its specific function:
- Google Analytics (Google LLC) — measures website traffic and usage so we can understand how the Website is used and improve it. It may set Cookies and process your IP address (anonymized/truncated where supported) along with device and usage data. You can opt out via the Google Analytics opt-out browser add-on.
- Resend — our transactional email provider, used to send account, security, billing, and support emails. It processes your email address and the contents of those messages.
- Hosting (European Union) — our application and User data are hosted on infrastructure located within the European Union (EU).
Some providers (for example, Google) may process data outside the EU/EEA. Where that happens, such transfers are carried out under appropriate safeguards, such as the European Commission's Standard Contractual Clauses. We do not sell your Personal Data, and we share it with these providers only to the extent necessary to operate the Service.
12. Dispute Resolution
- All issues or conflicts over this Policy must first be handled through dialogue. A written claim must be sent to the other party first.
- The recipient of a claim notifies the claimant of the outcome in writing within 30 calendar days of receipt.
- If the parties do not reach agreement within 50 days, the matter may be brought before a court of competent jurisdiction.
- Applicable law governs this Policy and the relationship between the User, the Administration, and Gamler.
13. Additional Provisions
- Gamler may make changes to this Policy without the User's consent.
- The new version takes effect when posted on the Website, unless the new version provides otherwise.
